Two men aged 31 and 26 were drinking in a hotel after being released from prison when they decided to rob a cab for more beer money.

McCart, 24, was bludgeoned to death. The two men were convicted of first degree murder in Nov. 1980.

The Ontario Court of Appeal overturned the convictions and ordered a new trial in Jan. 1983. One man pleaded guilty and both were convicted in Nov. 1983.

The Supreme Court of Canada overturned one of the conviction in May 1989. Rather than prosecuting him for a third time, the Crown accepted a guilty plea to the lesser charge of manslaughter.
